Terms and Conditions

1. Acknowledgment of Risk

We acknowledge that participants engage in our adventure activities not despite the risks, but with an understanding of them—and it is precisely this responsibility that forms the basis of our service.

By registering for or participating in any adventure activity offered by KonkanSparsh, you acknowledge and accept the inherent risks associated with such activities. These may include, but are not limited to, injury, illness, unpredictable weather, wildlife encounters, accidents, equipment failure, and other unforeseen hazards.

You affirm that:

  • You are physically and mentally capable of participating.
  • Your participation is voluntary, and you assume full financial responsibility for any personal injury, illness, property loss, or damage.
  • You accept that we are not liable for consequences resulting from any pre-existing medical condition.

2. Health & Medical Responsibility

  • You agree to disclose any medical condition that may affect your participation.
  • You accept full responsibility for your health and medical fitness, and acknowledge that any medical emergency or treatment cost incurred during the activity shall be borne entirely by you.
  • In case of emergency evacuation, our team will assist to the best of their ability in helping you reach the nearest accessible point (e.g., trek base or motorable road), but all associated costs shall be paid by you.

3. Safety and Conduct

All participants must:

  • Follow all safety instructions given by guides/instructors
  • Use safety equipment responsibly
  • Refrain from reckless, intoxicated, or dangerous behavior

Failure to follow safety protocols may result in removal from the activity without refund.

4. Participation Conditions

  • Age restrictions may apply depending on the activity.
  • Minors must be accompanied by a parent or legal guardian who agrees to these terms on their behalf.
  • If you choose or are forced to leave the activity early, no refund will be issued. We will assist with exit logistics to the best of our ability, but you will bear all related expenses.

5. Bookings and Cancellation Policy

  • Full payment is required to confirm participation.
  • Cancellation by participant:
    • 25+ days prior: 80% refund
    • 15+ days prior: 50% refund
    • Less than 7 days: No refund
  • Cancellation by organizer (due to weather or safety):
    • Full refund or alternative date will be offered.

6. Liability Waiver

By participating, you agree to release and hold harmless KonkanSparsh Team, its staff, agents, and partners from any liability related to:

  • Injury or illness
  • Property damage or loss
  • Delays or changes to the itinerary
  • Force majeure events

This includes situations during or after the activity resulting from pre-existing health conditions.

7. Insurance

We strongly recommend that you carry personal accident, travel, and medical evacuation insurance, especially for high-risk adventure activities.

8. Use of Photos and Videos

Unless otherwise informed in writing, you grant us the right to use images or videos taken during the activity for promotional purposes.

9. Governing Law

These terms and conditions shall be governed by and construed in accordance with the laws of the State of Maharashtra and the Republic of India. Any disputes arising out of or in connection with these terms shall be subject to the exclusive jurisdiction of the courts in Achara Malvan, Maharashtra.

10. Agreement

By registering or participating in any activity, you declare:

  • I have read and understood all the terms and conditions above.
  • I voluntarily agree and fully comply with them.
  • I accept financial responsibility for any injury, loss, or costs arising from my participation, including medical emergencies or early exits.
